Subject: Follow-up to the reply provided by Vice-President Mogherini on behalf of the Commission to Written Question E-008879-15

Question(s)

Since the Israeli blockade of Gaza is preventing the basic needs of the population from being fulfilled, does the EEAS/Commission acknowledge this and act according to the EU’s beliefs that such a state of affairs is in contradiction with international humanitarian law and international human rights?

Answer given by Vice-President Mogherini on behalf of the Commission (26.11.2015)

The EU has repeatedly called for a fundamental change of the political, security and economic situation in the Gaza Strip, including the end of the closure and a full opening of the crossing points, while addressing Israel’s legitimate security concerns.

The EU believes that compliance with international humanitarian law and international human rights law by states and non–state actors, including accountability, is a cornerstone for peace and security. It is not within the competencies or responsibilities of the European Union to make legal assessment of specific situations or policies.

The EU supports the international accountability mechanisms established by the relevant United Nations bodies and has repeatedly urged the parties to fully cooperate with them.

The EU also provides significant humanitarian assistance to the Gaza population and works closely with all parties to ensure efficient delivery.

L-UE ripetutament appellat għal bidla fundamentali tas-sitwazzjoni politika, tas-sigurtà u dik ekonomika fil-Medda ta’ Gaża, fosthom it-tmiem tal-għeluq u l-ftuħ sħiħ tal-punti ta’ qsim, filwaqt li jiġi indirizzat t-tħassib leġittimu tal-Iżrael dwar is-sigurtà.

L-UE temmen li l-konformità mad-dritt umanitarju internazzjonali u d-dritt internazzjonali dwar id-drittijiet tal-bniedem mill-Istati u atturi mhux statali, fosthom r-responsabbiltà, hija l-qofol għall-paċi u s-sigurtà. Mhuwiex fil-kompetenzi u r-responsabbiltajiet tal-Unjoni Ewropea biex tagħmel evalwazzjoni ġuridika ta’ sitwazzjonijiet speċifiċi jew politiki.

L-UE tappoġġa l-mekkaniżmi ta’ responsabbiltà internazzjonali stabbiliti mill-korpi rilevanti tan-Nazzjonijiet Uniti u ripetutament ħeġġet lill-partijiet biex jikkooperaw b’mod sħiħ magħhom.

L-UE tipprovdi wkoll assistenza umanitarja sinifikanti lill-popolazzjoni ta’ Gaza u taħdem mill-qrib mal-partijiet kollha biex jiġi żgurat it-twassil effiċjenti.
